On April 25, 1997, Judge William Osteen of the Federal District Court in Greensboro, North Carolina, ruled that FDA has jurisdiction under the Federal Food, Drug, and Cosmetic Act (the Act) to regulate nicotine-containing cigarettes and smokeless tobacco.
