What uses are allowed in the Special Water Resource Protection Area (SWRPA)?
Stormwater stabilization measures, up to 150 feet from the Category One water may be allowed, only if needed to meet offsite stability requirements, provide a 95% removal of TSS. Roads and bridges to address public welfare or those needed to access developable portions of a property may be permitted in a SWRPA. It must be demonstrated that the applicant is able to maintain the functional value and overall condition. Where the functional value is not maintained, the applicant may pursue the waiver for linear development projects at N.J.A.C. 7:8-5.2(3) or the hardship provisions under the review of the Flood Hazard Area Control Act, Freshwater Wetlands, CAFRA, and Waterfront Development permit programs.
