What transportation requirements apply to homeless students?
Under current state law, school districts are funded for transportation based on the prior year. Districts that transport eligible homeless students during the current school year (FY05-06) will receive transportation funding at settle-up in September 2006. School districts may transport homeless students within two miles, but there is currently no requirement to do so under federal or state law, and no funding available for it unless the school has a board policy for hazardous area service in accordance with TEC 42.155(d). TEA is pursuing additional information and options and will notify the districts of any changes in federal or state law, including policy changes that may affect this situation.
