What should the future agenda for employment law be?

Looking at the other side of the coin, it seems employers might be disinclined to “give someone a chance to prove themselves,” especially if they knew they were going to be faced with a long and drawn out process of documenting and then proving “just cause” in order to terminate an employee who didn’t work out…and then there’s the very real potential for litigation. Some say the concept of tenure, once so popular in our educational system, has bred apathy and mediocrity, and that merit based employment coupled with an ongoing evaluation process is the only way to assure a productive workforce. Just my opinion.
