What should I do if the PRP and/or his attorney request an informal meeting after the Department issues an NOV?
You should contact the attorney on the case and arrange for their attendance. Further, you should seek to find out what the Respondent is seeking in the meeting. If the Respondent is seeking to settle then mediation may be appropriate. ELRA provides 8 hours of free mediation. The Respondent should contact the Florida Conflict Resolution Consortium and pick a mediator through their organization. Mediation must be complete 15 days before the administrative hearing. See http://consensus.fsu.edu . If there is going to be a settlement conference or mediation, you should prepare ahead of time with the attorney on the case. Gather all the relevant information and discuss beforehand with the attorney what strategy you will use in the meeting. (i.e. the Department’s settlement position, what the Department wants from the mediation, additional information required, etc.) If the Respondent merely wants to dispute the facts, then the meeting should be denied and the disputed facts may be resolved
