What should a parent do if he or she disagrees with a school districts decision regarding school placement and best interest determination?
If a dispute arises between a school district and a homeless family regarding school placement, the child must be immediately enrolled in the school of the parent’s choice (usually, the school of origin) until the dispute is resolved. It is very important that the child not be kept out of school while the dispute is being resolved. Each school district must have a written dispute resolution policy in place. For issues that cannot be resolved at the local level, please refer to the state’s dispute resolution policy: http://www.doe.in.gov/alted/dispute_resolution.html The school district must make sure that it has apprised parents in writing of the school placement decision and the parent or student’s right to appeal the decision. The parent or unaccompanied student should be referred to the school district’s McKinney-Vento liaison, who is required to carry out the dispute resolution process.
