If the tenant is less than eight weeks in arrears then it would be up to the landlord to make an arrangement with the tenant to pay the outstanding balance. However if the tenant is eight weeks or more in arrears then the landlord must notify the authority of this. It is not up to the authority to find this out for itself. If the tenant disputes that there are eight weeks’ arrears the authority must consider the available evidence and come to a finding of fact on the balance of probability. Either party (the claimant or landlord) can appeal the authority’s decision.
