What rights does the incapacitated person have?
The incapacitated person has the right to receive a copy of the application for guardianship and other documents filed with the County Clerk. He or she is also entitled to be at the hearing to determine whether he or she is incapacitated, demand a jury trial and request that the hearing be closed to the public. An incapacitated person retains all legal and civil rights and powers, except those designated by the courts order appointing a guardian.
