What rights does a property owner have under the Unsafe Structures Code?
Under state law and local ordinance, the City must notify the owner, mortgagee and parties in interest that a hearing has been scheduled. The hearings are conducted by an impartial Hearing Officer who renders a decision after hearing from the City and the property owner. In most cases, the property owner can request and receive an extension to make repairs, not to exceed 90 days. Should the property owner not agree with the Hearing Officer’s decision, they can file for injunctive relief in the District Court.
