A HCW has the right to due process, which means the HCW, at a minimum, has a right to receive adequate notice, an opportunity to be heard and present evidence, the right to representation, and a right to an explanation about why the decision was made. The HCW has the right to know that the decision was not arbitrary, but based on actual evidence. This is why it is important to issue “Notice of Termination of Homecare Provider Enrollment and Number” (SDS 0613).
