Australian Constitutional Rights Our government Expressed Rights are – is unable to form a religion or restrict religion – is unable to discriminate based on location – is able to acquire property with ‘just’ terms – is mandated to provide jury trial for indictment Our governmentn Implied Rights are – separation of judicial power from government (impartial High Court think “the castle” or think the government can NOT incarcarate any citizen) – responsible governance (think freedom of political views and communication and compulsary voting) Because we are not restrained/contained by a Bill of Rights we the people can continue to negotiate our Rights based democratic election and our legal system remains independant from politices (a very very good thing). I’d recommend looking up pros and cons of a bill of rights to truly understand our freedom in having constitutional rights rather than a bill of rights.
