The criminal offences in the legislation are subject to the provisions of the Criminal Code Act 1995 (the Criminal Code) and therefore all protections included in the Criminal Code. To prevent easy evasion of the provisions by channelling inappropriate benefits through third parties, the new provisions hold requesters and providers responsible for the actions of third parties who engage in inappropriate practices.
