What protection is afforded by the Sale of Goods Act when purchasing specialist flooring?
Under the sale of goods act, the goods must be fit for purpose. If a specialist fitting service is part of the package, then the entire package of supply and installation must be fit for the purpose it was intended and supplied for. If the product has a claimed life of 20 years, but has failed after 5 years, it is clear that there is some fault. Doesn’t matter whether its the tile, the screed, the sealant or the installer, the package has failed and it is the responsibility of the supplier to provide a replacement or compensation. Do not accept any passing of the buck to the fitter, the glue manyfacturer or anyone else, its the responsibility of the supplier – who you signed the contract with – to provide the solution to the problem. If he needs to counterclaim on his suppliers or contractors, that’s his concern, not yours. I would advise your supplier that you intend to take legal action against him for replacement of the failed floors, and give him 14 days to come up with an acceptab
