What process is taken when a mother travels abroad with her child and without the father?
Unless there is a court order stating that either parent cannot leave the country due to the threat of abduction or something just as serious, the resident parent does not have to ask the non-resident parent for permission. If there is a contact order in place, the resident parent merely has to inform the non-resident parent of their intention to take a holiday and when they will return. If however, they are intending to move abroad permanently, the non-resident parent must make an application to the court to prevent this until such time that they can prove in court that it would not be in the childs’ best interest to move, but it’s unlikely that they would succeed in such a case unless in extreme circumstances.
