The law usually requires a longer notice period for a longer-term employee as a “proprietary right” to employment that grows the longer the person is in the position. Also a much longer-term employee often may have a more difficult time getting other employment. Also, an older employee, for example, between 45 and 60, would have a much harder time getting re-employed than a person not so close to retirement age, and may be entitled to more notice. The courts will look at many factors in any employee’s circumstances to determine what is reasonable notice.
