What notice does an employee have to give when returning from maternity leave?
The employee must provide her employer with written notice of the proposed date of her return to work no later than four weeks before that day. If the employee wishes to extend the period of maternity leave, they may do this once by providing the employer with at least 14 days notice before the end of the maternity leave period. It may be extended further by mutual agreement. If the employee wishes to shorten the period of maternity leave, this can be done by mutual agreement. The employee must also give 4 weeks written notice of the proposed date of return to work in these circumstances to take advantage of the return to work guarantee.
