What NJ laws apply to charter schools?
Except as expressly provided for in the New Jersey Charter School Act of 1995, all state laws and regulations that apply to district public schools apply to charter schools, including those regarding health and safety, civil rights and statewide student assessment and testing. N.J.S.A. 18A:36A-11(a). As is true for districts, each charter may apply to the commissioner of education for waivers of any regulations concerning public schools if the board of trustees satisfactorily demonstrates that the exemption will advance the educational goals and objectives of the school. N.J.S.A. 18A:36A-11(b). Charter schools are free from some of the organizational requirements that apply to district public schools. Charter schools control their own curriculum, staffing, organization and budget.
