The following elements typically must be demonstrated in a wrongful death claim: • The wrongful death was caused by the actions of the defendant (for example, the driver who caused an accident, the doctor who made an error or the negligent product manufacturer) • The defendant’s actions were negligent • The decedent left a surviving spouse, children, siblings or parents • There was a loss of support, grief, bereavement, burial/ funeral expenses, and medical expenses resulting from the victim’s wrongful death.
