It depends on which party benefits from settling outside of insurance. If it is the guy who hit you that is pushing to go outside of insurance, then you are doing him a favor. Whether you use insurance our go outside of it then you still get paid. The difference is that it is you who are assuming a risk by letting him go outside insurance. So in that case you should not sign ANY waiver at all. If he is not willing to take your word that you will not try to “screw” him by going to your insurance company after he pays you, then that is his problem… in that case go through normal channels and get the insurance payment. However, if it is you that for some reason that wants to settle outside of insurance (and why would this be? — if he is liable then there is no benefit to you in going outside of insurance), then the tables are turned and you are at his mercy…. your choices are sign the waiver or go through insurance.
