According to the IDENTITY THEFT AND ASSUMPTION DETERRENCE ACT of 1998 the penalty is a fine and or imprisonment up to 20 years. Also the personal property used to commit the crime will be confiscated. This is just one federal law and you can almost bet that other charges will be thrown in along with the state charges.
