The advertising of medical devices is not regulated by law in the Netherlands, other than the general advertising rules that apply to any advertising, such as a prohibition of misleading advertising. However, there is a self-regulatory Code on the advertising of medical devices of the industry organisation, Nefemed, which reflects the Code of Conduct of the European industry organisation Eucomed. Furthermore there are the codes of Diagned and EDMA. Also, the self-regulatory body Keuringsraad KOAG considers that advertising of medical devices must comply with the Code on the Advertising of Medicinal Products to the Public, thus e.g. allowing medical claims to be made and requiring prior approval of the advertising material by the KOAG.
