What laws and codes of practice govern the advertising of medical devices in Spain?
Law 29/2006 states that it is forbidden to make direct or indirect advertising to the public of those medical devices financed by the National Health System. Furthermore, the rules under such law which warrant the independence of health professionals shall also apply to those professionals who prescribe sanitary products. Royal Decree 1591/2009, of 16 October, regulates the advertising of medical devices. In general terms such norm sets out the information which shall be included in any advertisement of medical devices and requires a previous authorisation from the sanitary authorities for the advertising of medical devices to the general public. The Industry of Sanitary Technology (FENIN) has also a Code of Practice.
