There are no specific rules relating to advertising of medical devices. Rules on labelling which in some cases may be applied to advertising are contained in the Act on Medical Devices of 20 April 2004 (Journal of Laws of 2004 No 93, item 896) and in its implementing regulations. General rules, such as the ones contained in the UCCA, must also be followed. In particular, advertisement of medical devices cannot be misleading and ascribe to the devices properties of medicinal products. With regard to pharmacy advertising, the Pharmaceutical Law prohibits public advertising of the activity of pharmacies which directly refers to medical devices (and also medicinal products) subject to reimbursement, or medicinal products or medical devices which have names identical to those subject to reimbursement.
