Article 9, ยง 4 BMA prohibits advertising to the general public of implantable medical devices or acts consisting of placing or implanting implantable medical devices. An implantable medical device is a medical device intended to be entirely inserted in the human body or to replace the epithelium or eye surface through surgery and intended to remain there after that surgery. A medical device which is intended to be only partially inserted in the human body through surgery, but is intended to remain there for a period of at least 30 days will also be considered to be an implantable medical device. Article 10 BMA discussed above under sections 4 and 5, also applies to all types of medical devices.
