A. Eligible expenses under a dependent care FSA are defined as those that enable the employee and his or her spouse to work or look for work. These include payments to child care centers that care for 6 or more children and meet the IRS’ definition of a qualified day care center, caregivers for a disabled spouse or dependent who lives with the employee, and babysitters, nursery schools and household expenses if a portion of the expense is incurred to ensure a qualifying dependent’s well-being and protection.
