In order to secure the release of funding for LEA activities under Section D of the State’s plan implementing the new evaluation law, where applicable, an LEA and its teacher and principal collective bargaining agents must certify to the Department that their contracts are consistent with the provisions of Education Law §3012-c and the Commissioner’s regulations. If any teachers and/or principals in a school district are not represented by a collective bargaining agent, the school district must certify that it will evaluate those teachers and principals in accordance with all applicable provisions of Education Law §3012-c and Commissioner’s regulations. Once an LEA provides, where applicable, such a certification, the relevant apportionment will be available to the LEA to spend on implementation activities.
