What issues can a court of appeal hear?
A court of appeal decides questions of law, as opposed to questions of fact, such as whether the trial judge applied the law correctly to the facts that were found to exist by the trial judge or jury after hearing and considering all the evidence (including conflicting evidence). It does not overturn findings of fact unless there was NO competent evidence presented in support of those facts. Issues commonly brought to a court of appeal for review may include legal errors such as incorrect rulings on the admissibility of evidence, an incorrect application of a law or regulation, improper jury instructions, insufficient evidence to support the judgment, or an incorrect failure to consider evidence that would have impacted the judgment.
