The term “drunk driving†is a bit of a misnomer in that the law encompasses more than just driving while “drunk.†In fact, a person need not be “drunk†at all, at least as far as that term is generally understood to mean as falling down drunk. Rather, the law prohibits a person from driving or operating a motor vehicle while under the influence of alcohol, a controlled substance, or a combination of alcohol and a controlled substance, or any other drug which makes a person less capable of safely driving.
