TUPE stands for the Transfer of Undertakings (Protection of Employment) regulations, commonly referred to as TUPE. This provides that employees’ contracts of employment will continue after a transfer of a service to a new employer as if they had originally been made with the new employer. This means that terms and conditions such as hours, annual leave and pay remain unchanged. Where staff members served under a previous NHS trust this will be taken into account for statutory and contractual entitlements, for example: maternity, occupational sick pay and redundancy pay.
