The Workplace Safety and Insurance Appeals Tribunal (WSIAT or Tribunal) considers appeals from final decisions of the Workplace Safety and Insurance Board under the Workplace Safety and Insurance Act, 1997 (WSIA or Act). The Tribunal is a separate and independent adjudicative institution. It was formerly known as the Workers’ Compensation Appeals Tribunal, until the name was changed pursuant to s. 173 of the Act. Appeals are generally heard in person, before an adjudicator sitting alone or a three-person panel. A Tribunal hearing is not as formal as a court proceeding. However, representatives are expected to provide opening submissions, call witnesses, and provide closing remarks on how the law applies to the facts of their case. A written hearing process is commonly used for issues such as access appeals, time extension applications and employer appeals concerning account issues.
