What is the worst thing that can happen if I am convicted of DUI?
Illinois’ complex DUI laws are codified at 625 ILCS 5/11-501. If you have been arrested for a DUI, it is extremely important to take your arrest seriously. There are really two separate areas in the law: the criminal aspect which is prosecuted by the State’s Attorney, and the Statutory Summary Suspension provisions, which is an administrative process of the Office of the Secretary of State. For a first offender, the law allows up to 365 days in jail, and a fine of up to $2500. Aggravated DUI can carry a penalty of 6-30 years in prison and fines of up to $25,000. The maximum punishment rarely happens, but it is possible if you aren’t represented by a competent DUI lawyer. Criminal penalties become more severe in cases of multiple DUI convictions, ranging from mandatory county jail time to multi-year sentences to state prison.
