What is the “vicinity of the premises”?
So far this has no legal definition and ultimately the courts will have to decide what constitutes “vicinity”. Until then, the relevant Licensing Authority, who is by legal definition impartial to the outcome of premises licence applications, must determine whether the resident or business who may have objected is likely to be directly affected by the granting of the licence.
