Forgery is a criminal offense in Texas, but there is a limitation on how long after commission of the offense the government can prosecute an offender. How long the state has to file a charging instrument against someone accused of forgery will depend on whether the person is accused of misdemeanor or felony forgery. The Texas Penal Code defines the different types of forgery while the Texas Code of Criminal Procedure defines for how long after commission of the crime the violator can be prosecuted.
