The NRC is considering expanding the NSTS to include Category 3 sources, as well as some Category 4 sources (those with an activity that is equal to or greater than one-tenth of the Category 3 threshold). Toward that end, the NRC published a proposed rule for public comment on April 11, 2008 (73 FR 19749 ). The public comment period ended on June 27, 2008, and the NRC staff is in the process of analyzing the comments received. Consequently, the Commission has not yet made a final decision on whether to expand the NSTS. If the NRC proceeds with the inclusion of smaller sources in the NSTS, the agency will publish a final rule that addresses all of the comments, and the final rule will establish an effective date for licensees to begin reporting such sources.
