The State employment offices or State Workforce Agencies (SWAs) will no longer be the intake point for receipt of labor certification applications. They will no longer participate in the review or approval of labor certification applications. The sole role of the SWAs in the new system will be provideing prevailing wage determinations, which is one of the most important stage in the process because the employers will be required to obtain a prevailing wage determination from the SWA before filing the application with the DOL.
