What is the purpose of having covenants, conditions, restrictions, ordinances and standards?
TH/CR: County and municipal ordinances such as zoning, building, and fire codes limit the rights of property owners under the jurisdiction’s police power to protect health, safety and welfare. In areas where fire risk is high, these ordinances often incorporate Firewise subdivision development standards such as road widths and clearances, fuel breaks, non-flammable building construction materials, and defensible space around homes. As an added precaution some localities require the covenants, conditions, and restrictions (CC&Rs) of new subdivisions to include provisions for the maintenance of defensible space by homeowners. These CC&Rs place responsibility for maintenance with the property owners, and responsibility for enforcement with the homeowners’ association. Subdivisions can adopt Firewise CC&Rs by their own choice, without a requirement of the local government.
