What is the punishment for a first-offense DUI conviction?
First-offense DUI is a Class 1 misdemeanor punishable by up to a year in jail, a $2500 fine, and a one-year suspension of your driver’s license. The minimum punishment for a simple, first-offense DUI is a $250 fine and a one-year license suspension plus enrollment in an Alcohol Safety Action Program (ASAP) unless the court decides ASAP is inappropriate. (ASAP will cost you $250-$350.) There’s also an immediate 7-day administrative suspension of your license upon arrest if your BAC tests at 0.08 or higher. Judges usually impose 12 months of probation along with additional suspended fines and jail sentences. You pay the suspended fines and do the suspended jail time only if you violate probation. A restricted driver’s license may be issued for good cause shown, in the discretion of the Judge. If the suspect’s BAC is at least 0.15 but not over 0.20, there is a mandatory 5-day jail sentence.
