What is the procedure once a landowner applies for a Conditional Use Certificate?

0

The landowner obtains the Application from the Inspector (it may also be downloaded from the Township website), fills it out, and submits it. The Inspector is available to help in this process. The Inspector places it on the agenda for the next monthly BZA meeting. At that meeting, which the landowner should attend (but is not required to do so), the BZA has an opportunity to discuss the Application with the landowner and ask for additional information. Next, a hearing date is set. Notice is placed in the newspaper, and the immediate neighbors are notified by mail. At the hearing, a decision is made and any approval becomes effective immediately. Certain formalities are required of the BZA to memorialize the decision, and the landowner may also be asked to help prepare papers to formalize the decision. An appeal of the BZA decision may be taken to the Court of Common Pleas by either the landowner or the neighbors, among others. The appeal procedures are governed by ORC 2505 and 2506.
