What is the position regarding student rights when the research is initially unsponsored and later becomes sponsored?
Up to the point of sponsorship, the student would, in principle, own their intellectual property. Subject to the terms of the sponsorship agreement, the student may have no rights to intellectual property created from that point in time, even if they are not receiving a stipend or part-stipend from the sponsor. My student has been offered a ‘top-up’ scholarship by an external organisation that wants ownership over all intellectual property developed by my student during the course of their research project. The project has already been running for 12 months and up to this point has involved no other external party. What is the best way to proceed?
