Any person violating any of the provisions of tree ordinance shall be guilty of a violation and shall be fined not more than $500 and/or imprisoned not to exceed 15 days. Each day the violation continues shall constitute a separate offense. No building, demolition, or excavation permit may issue, and if previously issued, shall be revoked, until such violation is cured in accordance with §§ 260-8D and 260-5. In addition, any person violating any provision of the tree ordinance shall be subject to a civil penalty enforceable and collectible by the Town in the amount of $200 each day the violation continues for every tree. The violator will also be required to replace each tree removed, killed or destroyed in accordance with this chapter.
