The Notice of Non-compliance is not a criminal citation. It is a notice that provisions of the Tonto Pass program have not been followed for one of several reasons. The amount due is a compliance surcharge that is an alternative to a fine. Please pay the amount indicated. The Notice of Non-compliance is for the public’s convenience to allow individuals an alternative to receiving a citation which could be contested in federal court.
