What is the normal language for the project and/or finance documents?
Under GEO No. 54/2006, when a foreign entity is a party to a PFI/PPP project, the PFI/PPP agreement shall be drafted in four counterparts, two in the Romanian language and two in a foreign language chosen by the parties. The Romanian language version shall prevail. GEO No. 34/2006 makes no reference to the normal language to be used for the project and/or finance documents. However, as PFI/PPP arrangements involve Romanian public authorities as contracting parties, the Romanian language is expected to be deemed as the normal language to be used for projects and/or finance documents employed for the scope of PFI/PPP arrangements. In the near future, it is likely that the implementing rules to Chapter VII of GEO No. 34/2006 shall provide details in this regard.
