What is the NCAP Reconciliation Prototype?
The NCAP Reconciliation Prototype is a two-year test of the “Reconciliation” procedure, commencing October 1, 1998. Participation in the prototype is voluntary, and importers must file an application to participate. However, Customs encourages widespread importer participation, and has indicated that, after October 1, 1998, the NCAP Reconciliation Prototype will be the exclusive authorized method for “reconciliation” of import issues. The use of “block liquidation” or “block appraisement” procedures will not be authorized under any circumstances. Customs’ General Notice announcing the Reconciliation Prototype also distinguishes it from “voluntary disclosures”, in which an importer discloses to Customs a violation of law, and tenders any duties owing as a result of the violation, outside of the normal liquidation process. Unlike “voluntary disclosures”, Customs stresses, Reconciliations do not involve an assertion or admission that the importer has violated Customs’ civil penalty statut
