What is the legal process for making a compulsory purchase order?
The legal process for the making of an order is made up of a number of stages. In the first stage, the Council identifies what land is required for any particular purpose or scheme. The Council will then find out who owns what, which owners will sell their property, and which ones won’t agree to sell. Once the Council has established the proposed boundary of the land to be included in the CPO (the order land), it can proceed to the next stage. This will require the Council’s Executive Board to agree (make a resolution) to use CPO powers. The resolution will define the land to be acquired (by showing it on a plan) and say what it is needed for. In the next stage, we make further checks about who owns the property included in the order, and we also look at who may be a tenant either living or working in any building.
