Regulation 21 of the Public Contracts Regulations 2006 sets out the conditions for when an e-auction is run, and how it should be conducted. Regulation 20 contains the equivalent provisions in the Utilities Contracts Regulations 2006/6. It should be noted that the Procurement Regulations do not extend to Scotland. Organisations must take their own legal advice on the application of the procurement regulations.
