What is the law of Civil Procedure?
The law of civil procedure is part of procedural law. Substantive law indicates what a person’s rights, duties and remedies are in a given situation. Procedural law indicates the manner in which these rights, remedies and duties are to be enforced. Substantive law thus determines the content and scope of rights, duties and remedies whilst procedural law provides the procedure for the enforcement of such rights, duties and remedies. For example, substantive law determines the circumstances under which a person may have a damages claim arising from a motor vehicle accident, whereas procedural law prescribes how such a claim to be instituted.
