What is the law for Drunken Driving?
If anyone is found guilty of Drunken Driving, then he may have to pay a hefty amount for challan or may be imprisoned. The punishment depends upon the amount of alcohol consumed and frequency of occurrence of such an offense. Section 185 of the Motor Vehicles Act, 1988 provides for the penalty to be imposed for such voilation.It states that if one is driving or attempting to drive a motor vehicle and has 30 mg per 100 ml of blood or is under the influence of Drugs to such an extent that he is incapable of excersing proper control over his vehicle is said to be doing drunken driving. Such a person could be punished with an imprisonment of 6 months or with fine which may extend to Rs. 2000/- or with both for the first offence and subsequently if a similar offence is committed within three years with imprisonment upto 2 years and with fine upto Rs 3000/- or with both.
