What is the law firms general approach to dispute resolution?
There are some general maxims which apply. It is better to avoid litigation if possible. It is always better to have an amicable relationship. It is better to have a negotiated resolution than a resolution dictated by a judge. That being said, clients’ interests must be protected as a paramount concern. If your interests can be protected while maintaining an atmosphere of good will and without litigation, so much the better, particularly in matrimonial situations involving children where there is a continued relationship in the future as co-parents. However, if there are dangers to protecting your interests without action being taken, such as assets being lost, the threat of physical or emotional abuse or custody violations, then litigation may need to be instituted immediately and injunctions or other security devices sought.
