On 17 November 2009 His Honour Judge Bidder QC dismissed the application for judicial review of the decision by Hampshire County Council to grant planning permission for the South East Hampshire Bus Rapid Transit Phase 1. However, the applicant then applied to the Court of Appeal for leave to appeal and this was granted by the Rt Hon Lord Justice Sullivan. The hearing will take place before the end of March 2010. In addition, a further interim injunction has been granted, which effectively stops work again on the building of the Bus Rapid Transit (BRT) Phase 1 in Gosport. The County Council is disappointed at this outcome, and will contest the appeal. In the meantime, we are seeking to have the injunction discharged or varied.
