What is the issue in McCullough vs Maryland?
The issue was that of Federal Power vs. State Power. When the Congress decided to establish its Second United Bank (after the first one flopped), the states viewed it as unconstitutional to their sovereign rights. They were compelled that the Constitution said nothing on Banking. Maryland decided to set an example by levying a tax against the bank. They refused to pay, so Maryland sued. They took it to the Supreme Court. The Supreme Court decided in favor of Congress, because the Supremacy Clause called for the states to yeild to the national government on issues not addressed. Congress was allowed to keep the bank open, and not have to pay state taxes.
